Converting Discussion into Administrative Mandates

Informal discussions do not generate discoverable public records. Under open-meeting statutes (e.g., California Brown Act), agency liaisons must record and transmit formal motions. Use these pre-scripted motions:

MOTION A: The 60-Day Mandatory Compliance & SOGI Intake Audit
"I move that this body direct administrative staff to conduct an immediate statutory compliance audit of all current intake forms, electronic case records, and third-party vendor assessments against state non-discrimination mandates and AB 959 SOGI standards, delivering formal written findings and an operational remediation schedule to this body no later than [Insert Date 60 days out]."
Procedural Mechanism: Requires a second, triggers a recorded roll-call vote, and creates an official public compliance record.
MOTION B: The Disaggregated Equity & Throughput Audit
"I move that department staff prepare and deliver a quarterly service-delivery report disaggregating intake velocity, wait times, provider placements, and grievance resolutions by demographic category and specialized need, to identify systemic administrative bottlenecks."
Procedural Mechanism: Shifts evidentiary burden from the public to administration using empirical throughput data.
Part 2: Front-Counter & Vendor Protocol

Intake Architecture & Contract Audit Rubric

Check Audit Benchmark Statutory / Theoretical Trigger
[   ] Elimination of Forced Binaries: Mandatory M/F checkboxes removed from intake. CA Gov Code § 8310.8 (AB 959)
[   ] NASEM Two-Step Measurement: Standard captures (1) sex assigned at birth and (2) current gender identity. NASEM SOGI Guidelines
[   ] Identity Separation: Legal names (restricted to billing/compliance) isolated from public rosters and badges. Administrative Dignity Safeguards
[   ] Burden Reduction: Redundant signatures, paper-only hurdles, and in-person drop-offs eliminated. Christensen et al. (2020)
[   ] Vendor Breach Covenants: Contracts contain immediate termination clauses for documented civil rights violations. Public Contract Code
Part 3: Institutional Defense

Anti-Burial Bylaw Protections

1. The 60-Day Subcommittee Sunset Clause:
"Any policy inquiry referred to subcommittee must return with actionable findings within 60 calendar days, or automatically revert to the main agenda for open debate and action."
2. Mandatory Governing Body Transmission:
"All recommendations passed by majority vote must be transmitted in writing to the governing body (Board of Supervisors / City Council / School Board) within two regular meeting cycles."
3. Verbatim Public Record Standards:
"Staff commitments, deadlines, and roll-call votes must be recorded verbatim in official public minutes to prevent administrative reinterpretation."
